TERMS & CONDITIONS - APPLICABLE TO ALL AUCTIONS & SALES
This is a Binding Contract That Cannot Be Cancelled or Withdrawn
Placing a Bid on an Auction: Buyer understands and agrees that placing a bid on an auction item constitutes Buyer creating a legally binding, legal contract with the Seller, for the purchase of Item on the terms stated in the listing.
Buyer agrees that all bids are final and cannot be retracted or cancelled and buyer agrees auction rules prohibit cancellation of any bid and and the buyer accepts all items “as is” at the time of sell and accepts all risk of making their item bid decisions based his/her review of pictures provided in the listing.
Buyer further understands and agrees that if Buyer’s bid is the winning bid, Buyer shall complete the purchase of the Item, and that Buyer’s purchase will be subject to all terms stated by the Seller in the Listing and the terms of this User Agreement.

TYPE OF TRANSACTIONS: New and used firearms are offered for sale by competitive bidding and for immediate sale using a Buy It Now Option, this is called an auction. In an auction firearms are often offered for sale at a much lower price than normally sold at retail, when there are a lot of items are for sale or when the seller desires to move merchandise rapidly.
APPLICABLE TO NEW & USED GUNS; We recommend that all guns be inspected by a qualified gunsmith before loading or firing, since new and used guns, can have issues we do not know about and we do not know the history of guns we obtain from other gun shops or dealers. If the auctioneer is aware of a problem he will state it in the auction listing. When rapidly listing firearms for auction a defect might not be noticed, so please have guns inspected. No Refunds, No Returns, No Warranty Whatsoever.
WAR TIME GUNS – HISTORICAL RELICS: Buyers agree that all war time guns are sold as historical (non-firing) relics, for parts use and as wall hagers. We cannot make any guarantee regarding war time guns. Buyer's agree not to load any war time gun until the gun has been throughly inspected and determined safe by a competent gunsmith.
APPLICABLE TO GUN PARTS & PART GUNS; We suggest part firearms be repaired as needed or used for parts and thoroughly inspected by a competent gunsmith before using the parts or repairing the parts gun. Parts guns are sold either with all parts present or with missing parts. Parts guns are sold intended for needed repair parts and are not considered safe to load or fire, until properly repaired. These firearms are sold AS-IS. No Refunds, No Returns, No Warranty Whatsoever.
PAYMENT DUE: All internet online credit card payment for items must be made within three (3) days of close of auction, or you must communicate to us if you intend to pay by check or money order, and the payment will be made after (3) days.
APPLICABLE TO ALL GUN SALES; All antique and modern firearms sold by us require a FFL. Air Rifles and Black Powder firearms do not require a FFL. Buyer's agree to submit a copy of their designated FFL that we will ship to after the auction. We do not ship to Curio License Holders.
LIABILITY WAIVER; When buying a firearm from us, you agree to have the gun inspected by a competent Gunsmith and you specifically release us from any liability from selling the firearm and you agree to accept all risk of loss. Many of our used firearms come from other dealers and estate auctions and we do not know the history on these firearms. Take this into consideration when bidding.
FIREARM INSPECTIONS; We do not have staff to disassemble, clean and inspect all the guns we sell. Such inspections would substantially increase the offered for auction or buy it now sale price. We recommend all firearms be inspected by a qualified gunsmith prior to loading, firing or using to ensure the firearm is in safe operating condition. Failure to do so may result in property damage, injury or even death.
ALL GUNS & PARTS ARE SOLD AS-IS;All part guns, used firearms and new firearms are sold AS-IS. No Refunds, No Returns, No Warranty Whatsoever. New gun customers may have an applicable warranty from the manufacture, but there is no warranty whatsoever by Angels Armory & Forge, and/or US Weapons Auction.
READ DESCRIPTIONS OF FIREARMS BEING AUCTIONED; Please read the descriptions of firearms before placing a bid or using the buy now option. We list pictures of every firearm we sell or auction. Use the pictures to judge condition. We do not specify the firearms cosmetic appearance. If we know of a mechanical problem with the gun, we state it in the description. If you have a concern or question, ask before bidding or buying a gun. All used guns are sold as pictured in our Gunbroker listings. Use the pictures to judge the used guns condition. Used firearms may have scratches, dents, dings, bluing wear and or discoloration, stock shrinkage, stock wear, flaws, defects, imperfections and other cosmetic issues. Buyers should not consider used guns to be in excellent condition, they are used guns.
WHEN BUYING FROM AUCTIONS YOU AGREE TO WAIVE LIABILITY & HAVE GUNS INSPECTED; By placing a bid, the Buyer acknowledges and agrees that the Seller will not be held responsible for any damages, injury, or death resulting from defective merchandise, misuse, or by customer disregarding warnings and disclaimers, or from failure to have the firearm properly inspected by a competent Gunsmith.
BUYER COMPLIANCE WITH TERMS & LAWS; Buyer agrees to comply with all terms of auction outlined in the firearms listing by Angels Armory & Forge and as set forth by GunBroker.com. Buyer states he or she is in total compliance with all applicable laws regarding the purchase and receipt of a firearm.
FIREARMS SHIPPING INSURANCE; All packages are insured via USPS Priority for $100. Any additional insurance beyond the $100 is at the request of the customer and additional cost apply.
If you do not insure your purchase, we will not be held liable for damage or loss. Failure to obtain insurance will result in you accepting all loss in event of damage, theft or incidents in shipping.
If you wish to have insurance coverage you must specify that to us in a separate e mail and add an additional fee of $ 3.00 per hundred dollars of coverage desired, payable by a separate check mail to us for insurance. Failure to obtain insurance will result in you accepting all loss in event of damage, theft or incidents in shipping.
ITEMS LOST, STOLEN OR DAMAGED IN SHIPPING; If we ship an item and it is lost, damaged or stolen during shipping, you must communicate that to us. All items have $100.00 dollars of insurance when shipped. We will provided you with the tracking number and insurance amount the item was insured. In as much as you are on the receiving end and knowledgeable of what loss or damage took place, you must file the insurance claim with the post office and process all paperwork. We will notify ATF if an item was stolen during shipping, based upon your communication to us.
FIREARM SHIPPING TIME FRAMES & COST; We ship everything the same or next business day. If you purchase something on Saturday afternoon, or Sunday, it will not ship out until Monday, when the post office opens. We do our part to get the item to you as quickly as possible. The speed at which the carrier delivers an item it is out of our control. If your item is late or delayed from your time expectation, please have some patience.
SHIPPING COST: Shipping costs are on the rise and are again, out of our control. We mainly use new packing materials as well as specially purchased firearm shipping boxes for guns. These cost money... they are not free. Shipping is at a cost to us just charging the actual shipping cost.

FIREARM SHIPPING TO DEALERS ONLY; We ship by the US Postal Service Only. We ship firearms to federal licensed firearms dealers only. We do not ship to Curio/Relic Licensed Persons.
OBLIGATION TO PAY FOR ITEMS; If you make an offer and it's accepted, accept a counter offer or win an auction, your obligated to pay for the item. In the event that you do not pay, you will be blocked from any future bidding and appropriate feedback will be left.
WE DO NOT CANCEL AUCTION BIDS OR BUY IT NOW SALES; We do not cancel orders, buy it now purchases, or cancel or remove sales or bids on auction items. Auction items are sold as is and are non- returnable.

ENSURE YOUR SHIP TO ADDRESSES ARE CORRECT; Please make sure your address is correct before purchasing. Please make sure the ship to dealer name and address is correct. We do NOT change ship to addresses and will only ship to the address you provided at checkout. We do NOT do returns. If we ship to an address you provided at checkout and it was incorrect and the item has to be returned to us, you will be responsible for initial shipping, return cost and the correct new ship to address.
RELEASE OF LIABILITY; By purchasing an item, entering a bid or making an offer, you (the Buyer) agree to release the seller from all liability, whether criminal or civil, arising from the purchase, ownership, possession, use or misuse of items puchased at auction. You further agree to all of the sellers terms set forth in these auction terms, auction sale terms and/or listings.
SHIPPING TO YOUR DESIGNATED DEALER; YOU ARE RESPONSIBLE FOR KNOWING YOUR LOCAL LAWS BEFORE BIDDING OR PURCHASING ANY ITEM. ALL NFA RULES APPLY. ONCE YOU HAVE PAID FOR AN ITEM AND WE SHIP IT TO YOUR DESIGNATED DEALER, IT IS TOTALLY YOUR RESPONSIBILITY TO BE ABLE TO OBTAIN THE ITEM FROM YOUR DESIGNATED DEALER.
HOLDING ITEMS/WAITING FOR A SHIP TO FFL; ALL PAID ORDERS WILL BE HELD UP TO 30 DAYS, IF WE ARE AWAITING RECEIPT OF YOUR FFL. IF YOUR FFL OR ID HAS NOT BEEN RECEIVED, OR YOU HAVE NOT CONTACTED US WITHIN THAT TIME FRAME THE ORDER AND ANY PAYMENT WILL BE FORFEITED.
